Freelance Isn't Free

I recently spoke with Buffalo Business First about the Freelance Isn't Free Act, which Governor Hochul signed into law November 22, 2023. While the Act does not go into effect until May 20, 2024, I recommend that businesses of all sizes (and freelancers!) become familiar with its central provisions. The Act, in part, provides an avenue for a freelancer to bring a civil action against a hiring party (i) that refuses to formalize the terms of their agreement in a written contract; and (ii) that fails to timely pay the freelancer for their work.

“Freelance workers are not really protected like a W2 employee, and they fall through the cracks. The main takeaway of this law is to protect these people and give them the tools they need to level the playing field.”
