Physician Supervision Rules Reinstated as COVID-19 Emergency Declaration Ends

New York Governor Cuomo announced that effective June 24, 2021, the New York State Emergency Declaration expired, and along with it, so have numerous Executive Orders and successive COVID-19 emergency declarations that began with Executive Order 202 in March, 2020. 

Physician Supervision and Collaboration Requirements required by NY Education Law are thus reinstated, once again requiring physician supervision and or collaboration requirements for non-physician health care practitioners including nurse practitioners, and various Title VIII professionals.

The announcement came abruptly, leaving many scrambling to comply. New York State Department of Health issued a statement that acknowledged the short notice, but instructed health professionals to exercise due diligence and good faith to return to compliance with the law. It encouraged practitioners to continue to monitor the New York State health Department's website for updated guidance.
