When the federal government reopened last week, the bill that allowed it to do so included a provision which closed a loophole that allowed manufacturers to convert hemp into many THC products. That provision now limits THC volumes to no more than 0.4 milligrams per-container, which essentially bans the majority of THC products currently in the market.
It is devastating news for anyone in the hemp market, according to our Aleece Burgio. Although the ban is not scheduled to take effect until November 2026, and it may result in less competition for adult recreation cannabis producers, it is creating a lot of uncertainty and a lack of clarity, as she shared this week with Buffalo's news/talk radio station WBEN-AM.
"More than 85% of anything that is on the shelves is no longer compliant. There's a lot of ambiguity between what's hemp and what's adult-use cannabis, what's medicinal, what's adult-use cannabis."
